Welcome to Moutai America. These Terms of Service ("Terms") govern your access to and use of the Moutai America website, products, and services. By accessing this website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not agree with these Terms, please do not use this website or purchase products from us.

Eligibility

By using this website and purchasing alcoholic beverages, you represent and warrant that:

  • You are at least 21 years of age.

  • You are legally permitted to purchase alcoholic beverages in your jurisdiction.

  • The recipient of the shipment is also at least 21 years of age.

  • You are purchasing products for lawful personal use and not for unlawful resale.

Moutai America reserves the right to request age verification, refuse service, cancel orders, or deny delivery if these requirements cannot be verified.

Compliance with Alcohol Laws

All alcoholic beverage orders are fulfilled by licensed alcohol retailers in accordance with applicable federal, state, and local laws.

Availability of products and shipping destinations may change without notice due to regulatory requirements.

Moutai America reserves the right to refuse or cancel any order that cannot legally be fulfilled.

Shipping Restrictions

We currently ship within the United States only to states where direct shipment of spirits is legally permitted.

At this time, we do not ship to:

  • Alaska

  • Hawaii

  • South Dakota

  • Utah

Additional restrictions may apply based on state or local law.

We do not ship to:

  • P.O. Boxes

  • APO/FPO or military addresses

  • International destinations

Customers are responsible for ensuring alcoholic beverage shipments are lawful in their destination jurisdiction.

Adult Signature Requirement

Federal and state law require that all alcohol shipments be delivered only to an individual who is 21 years of age or older.

The recipient must present a valid government-issued photo ID upon delivery.

Alcohol shipments:

  • Cannot be left unattended.

  • Cannot be delivered without an adult signature.

  • Cannot be delivered to minors.

We strongly recommend shipping to a business or residence where an adult will be available during normal delivery hours.

Orders

All orders are subject to acceptance and product availability.

Receipt of an order confirmation does not constitute acceptance of your order.

Moutai America reserves the right to:

  • Refuse or cancel any order.

  • Limit quantities purchased.

  • Correct pricing or inventory errors.

  • Cancel orders suspected of fraud, unauthorized transactions, or violations of applicable law.

If an order is cancelled by Moutai America after payment has been processed, a full refund will be issued.

Order Processing

Orders are generally processed within 1–2 business days.

Processing times may vary during holidays, product launches, or periods of high order volume.

Once an order has been shipped, it cannot be modified or cancelled.

Order Modifications & Cancellations

If you need to modify or cancel an order, you must contact us immediately at info@moutaiamerica.com.

If your order has not yet shipped, Moutai America may approve the cancellation at its sole discretion.

Approved cancellations are subject to a 10% cancellation fee to cover payment processing, fraud prevention, administrative, and fulfillment preparation costs.

Once an order has shipped, it cannot be cancelled.

Returned Shipments

If a shipment is returned to the licensed fulfillment retailer because:

  • No adult age 21 or older was available to sign;

  • The shipping address provided was incorrect or incomplete;

  • Delivery was refused;

  • The recipient failed to claim the shipment; or

  • The package was returned for reasons outside the control of Moutai America,

the customer will be contacted after the shipment is received.

The customer may choose one of the following options:

Option 1 – Reshipment

Returned packages may be reshipped after payment of the actual cost of the new shipping label and any applicable carrier charges.

Option 2 – Refund

If the customer chooses not to have the returned shipment reshipped, the order will be refunded less a 15% processing and restocking fee.

Original shipping charges, carrier fees, and payment processing costs are non-refundable.

Shipping Charges

Shipping charges displayed during checkout are non-refundable except where required by law or when the error was caused solely by Moutai America or the licensed fulfillment retailer.

If a returned package requires reshipment, the customer is responsible for paying the actual cost of the replacement shipping label before the order will be shipped again.

Product Availability

All products are subject to availability.

Occasionally inventory discrepancies may occur.

If a purchased item becomes unavailable before shipment, Moutai America may:

  • Cancel the affected item;

  • Offer a substitute with customer approval where legally permitted; or

  • Issue a refund for the unavailable product.

Product Information

We strive to ensure product descriptions, pricing, bottle images, packaging, vintages, and availability are accurate.

Manufacturers may update packaging or bottle designs without notice.

Product photographs are for illustrative purposes and may not exactly represent the item received.

Pricing

All prices are listed in U.S. Dollars.

Prices, taxes, shipping charges, and availability are subject to change without notice.

Applicable taxes will be calculated during checkout.

Delivery

Estimated delivery times are not guaranteed.

Once an order has been transferred to the carrier, Moutai America is not responsible for delays resulting from:

  • Weather

  • Carrier service interruptions

  • Natural disasters

  • Government actions

  • Wildfires

  • Other events beyond our reasonable control

Damaged, Defective, or Incorrect Orders

Please inspect your order immediately upon delivery.

Claims for:

  • Damaged products

  • Defective products

  • Missing items

  • Incorrect shipments

must be submitted within 7 days of delivery.

Please include:

  • Order number

  • Photographs of the package

  • Photographs of the shipping label

  • Photographs of the damaged or incorrect product

Approved claims may result in a replacement, store credit, or refund at Moutai America's discretion.

Returns

Due to federal and state alcohol regulations, all alcoholic beverage sales are final except where required by law.

Returns are accepted only for:

  • Products damaged during transit

  • Defective products

  • Incorrect items shipped

  • Other circumstances required by applicable law

Unauthorized returns will not be accepted.

Intellectual Property

All content on this website, including logos, trademarks, graphics, photographs, product descriptions, videos, software, and website design, is the property of Moutai America or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission.

Prohibited Use

You agree not to:

  • Violate any applicable law or regulation.

  • Purchase alcohol for unlawful resale.

  • Attempt unauthorized access to our systems.

  • Use this website for fraudulent purposes.

  • Interfere with the operation or security of this website.

Disclaimer of Warranties

This website and all products and services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Moutai America disclaims all express and implied warranties, including warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Moutai America, its affiliates, licensed retailers, employees, officers, directors, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of this website or the purchase, shipment, or delivery of products.

In no event shall Moutai America's total liability exceed the total amount paid by the customer for the applicable order.

Indemnification

You agree to indemnify, defend, and hold harmless Moutai America, its affiliates, licensed retailers, employees, officers, directors, and service providers from any claims, damages, liabilities, costs, and expenses arising from:

  • Your violation of these Terms.

  • Your misuse of the website.

  • Your violation of any applicable law or regulation.

  • Your negligent or unlawful conduct.

Privacy

Your use of this website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in California, except where otherwise required by applicable law.

Changes to These Terms

Moutai America reserves the right to update or modify these Terms of Service at any time.

Changes become effective immediately upon posting to this website.

Your continued use of the website after any changes constitutes acceptance of the revised Terms.
